1. Introduction
At FUSD, we believe privacy is a fundamental right. This Privacy Policy explains how we handle your information when you use our cryptocurrency swap services. We are committed to minimizing data collection and being transparent about our practices.
Our Privacy Commitment: We collect only the minimum data necessary to provide our services, we never sell your personal information, and we give you control over your data wherever possible.
2. Information We Collect
We collect minimal information to facilitate your FUSD purchases:
Information You Provide
- Zano Wallet Address: Required to deliver FUSD to your wallet
- Transaction Amount: The USD amount you wish to convert
- Email Address: Only if you opt-in for transaction notifications
Information Collected Automatically
- Transaction Records: Records of completed swaps for customer support
- Basic Analytics: Anonymized usage data to improve our service
What We Don't Collect: We do not collect or store your identity documents, selfies, proof of address, government IDs, or any other KYC-related information. All identity verification is handled exclusively by MoonPay.
3. Identity Verification & MoonPay
To comply with legal requirements, our payment provider MoonPay performs Know Your Customer (KYC) identity verification. This is a regulatory requirement for fiat-to-crypto transactions and is handled entirely by MoonPay—not by us.
How MoonPay's KYC Works
When you make a purchase, MoonPay may require you to verify your identity. This process includes:
- Government-issued photo ID (passport, driver's license, or national ID)
- Proof of address documents (utility bills, bank statements less than 3 months old)
- Selfie or 3D liveness verification
- Source of funds verification for larger transactions
MoonPay's Data Handling
According to MoonPay's privacy policy:
- KYC data is collected and stored directly by MoonPay
- MoonPay retains identity verification data to comply with anti-money laundering (AML) laws
- Data is processed through secure, encrypted channels
- MoonPay operates under regulations including FCA (UK), EU MiCAR (Europe), and state licenses (USA)
Important: We do not have access to your KYC documents or identity verification data. This information flows directly to MoonPay and is never transmitted to or stored by us. For questions about how MoonPay handles your data, please refer to MoonPay's Privacy Policy.
4. How We Use Your Information
We use the limited information we collect for the following purposes:
- Service Delivery: To process your FUSD purchase and deliver tokens to your wallet
- Customer Support: To assist you with any issues or questions
- Transaction Records: To maintain records for dispute resolution
- Service Improvement: To analyze aggregated, anonymized data and improve our platform
- Legal Compliance: To comply with applicable laws and regulations
5. Information Sharing
We never sell your personal information. We only share information in the following limited circumstances:
- MoonPay: Your transaction request is processed through MoonPay for payment and identity verification
- Blockchain Networks: Your wallet address is published on the Zano blockchain as part of the transaction (this is inherent to blockchain technology)
- Legal Requirements: If required by law, court order, or government regulation
- Service Providers: Trusted providers who help us operate our service (bound by confidentiality agreements)
6. Data Security
We implement industry-standard security measures to protect your information:
- Encrypted data transmission (TLS/SSL)
- Secure infrastructure with access controls
- Regular security assessments
- Minimal data retention practices
While we implement strong security measures, no system is completely secure. We encourage you to use strong passwords and keep your wallet credentials safe.
7. Data Retention
We retain transaction records only as long as necessary for customer support, legal compliance, and dispute resolution—typically no longer than required by applicable financial regulations. We do not retain any identity verification data, as this is handled by MoonPay.
8. Your Privacy Rights
Depending on your jurisdiction, you may have the following rights:
- Access: Request a copy of the data we hold about you
- Correction: Request correction of inaccurate data
- Deletion: Request deletion of your data (subject to legal retention requirements)
- Portability: Request your data in a portable format
- Objection: Object to certain types of processing
For requests related to KYC data, please contact MoonPay directly at [email protected], as we do not have access to that information.
9. Cookies and Tracking
We use minimal cookies necessary for the operation of our service. We do not use tracking cookies for advertising purposes. Any analytics we use are anonymized and aggregated. You can control cookie settings through your browser preferences.
10. Children's Privacy
Our services are not intended for individuals under 18 years of age. We do not knowingly collect information from minors. If we become aware that we have collected data from a minor, we will delete it promptly.
11. International Data Transfers
Your information may be processed in countries other than your own. We ensure appropriate safeguards are in place for any international data transfers in compliance with applicable data protection laws.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated through our website. We encourage you to review this policy periodically. Your continued use of our services after changes constitutes acceptance of the updated policy.
