1. Introduction

Welcome to FUSD ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our cryptocurrency swap services, which enable you to purchase FUSD stablecoin using fiat currency. By using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

2. Service Description

Our platform facilitates the purchase of FUSD stablecoin through a fiat-to-crypto on-ramp service. The process involves:

• Payment processing through our third-party payment provider, MoonPay
• Conversion of fiat currency to USDC
• Automatic swap of USDC to FUSD
• Delivery of FUSD to your designated Zano wallet address

3. Eligibility

To use our services, you must:

• Be at least 18 years of age or the age of majority in your jurisdiction
• Have the legal capacity to enter into binding agreements
• Not be located in a jurisdiction where cryptocurrency transactions are prohibited
• Successfully complete the identity verification (KYC) process required by our payment provider
• Not be on any sanctions lists or restricted persons lists

4. Identity Verification (KYC)

Our payment provider, MoonPay, is required by law to perform Know Your Customer (KYC) verification to comply with anti-money laundering (AML) regulations and prevent fraud. This verification process is conducted entirely by MoonPay and may include:

• Government-issued photo identification (passport, driver's license, national ID)
• Proof of address documentation (utility bills, bank statements)
• Selfie or 3D liveness verification
• Source of funds verification for larger transactions

We do not collect, store, or process your identity verification documents. All KYC data is handled directly by MoonPay in accordance with their privacy policy and applicable regulations.

5. Risk Disclosures

IMPORTANT: Cryptocurrency transactions involve significant risks. By using our services, you acknowledge and accept the following:

• Price Volatility: The value of cryptocurrencies, including FUSD, can fluctuate significantly. You may receive less value than you originally invested.
• Irreversible Transactions: Cryptocurrency transactions are generally irreversible. Once FUSD is sent to your wallet, the transaction cannot be undone.
• Wallet Security: You are solely responsible for the security of your Zano wallet and private keys. Loss of access to your wallet may result in permanent loss of your FUSD.
• Technical Risks: Blockchain networks may experience delays, congestion, or technical issues that could affect transaction processing times.
• Regulatory Risks: Cryptocurrency regulations vary by jurisdiction and may change, potentially affecting your ability to use or transfer FUSD.
• No Investment Advice: We do not provide investment, financial, legal, or tax advice. You should consult qualified professionals before making any financial decisions.

6. Transactions and Fees

All transactions are subject to the following terms:

• Transaction fees and exchange rates will be displayed before you confirm your purchase
• Fees may include payment processing fees, network fees, and swap fees
• Exchange rates are determined at the time of transaction and are subject to market conditions
• Minimum and maximum transaction limits may apply

7. Refund Policy

Due to the nature of cryptocurrency transactions:

• Completed transactions are generally non-refundable once cryptocurrency has been delivered to your wallet
• Refund requests for failed or incomplete transactions will be reviewed on a case-by-case basis
• Any refunds will be processed in the original payment currency, minus any applicable fees already incurred
• Refunds for payment-related issues are subject to MoonPay's refund policies

8. Prohibited Activities

You agree not to:

• Use our services for any illegal purpose or to facilitate illegal activities
• Provide false, inaccurate, or misleading information
• Attempt to circumvent identity verification requirements
• Use our services to launder money or finance terrorism
• Interfere with or disrupt the operation of our services
• Use automated systems or bots to access our services
• Violate any applicable laws, regulations, or third-party rights

9. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" without warranties of any kind, express or implied
• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• We are not responsible for losses resulting from market volatility, wallet security issues, or incorrect wallet addresses provided by you
• Our total liability shall not exceed the amount you paid for the specific transaction in question

10. Third-Party Services

Our services integrate with third-party providers, including MoonPay for payment processing and identity verification. Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or practices of third-party service providers.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or via email. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.

12. Termination

We reserve the right to suspend or terminate your access to our services at any time, without prior notice, for any reason, including but not limited to violation of these Terms, suspected fraudulent activity, or regulatory requirements. Upon termination, any pending transactions may be cancelled or completed at our discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration, except where prohibited by law.
